SC//Connect™ Secure SD-WAN Solutions User License Agreement
1) User License Agreement (ULA)
Scale Computing™ SC//Connect™ secure SD-WAN solutions software user licenses are distributed to customers through authorized Scale Computing partners and are subject to the terms of the Scale Computing Reseller Agreement.
Whether distributed under the Scale Computing brand or re‑branded as a white‑label service by an authorized partner, all SC//Connect software user licenses are subject to the Scale Computing Acceptable Use Policy (AUP).
2) Acceptable Use Policy (AUP)
Customer agrees to use Scale Computing Services in accordance with all applicable laws, regulations, and rules, and to obtain all approvals, consents, and authorizations necessary to conduct business and initiate or conduct any transmissions over any facilities covered by this Agreement.
In addition, Customer agrees to use Scale Computing Services in accordance with the guidelines, manuals, instructions, and the list of acceptable uses provided by Scale Computing, which may be updated from time to time.
Conduct that violates this policy includes, but is not limited to, the following activities when such violations involve or use Scale Computing’s network or servers:
a) Communications and Marketing Abuse
Use of automatic dialing‑announcing devices (“ADADs”) or automatic dialing devices, which are strictly prohibited; initiating or propagating electronic chain letters; and outbound telemarketing, spam, or mass marketing via email that violates accepted marketing practices or applicable laws in North America.
b) Service Provider Violations
Use of Services in a manner that would violate Scale Computing’s contracts with its service providers.
c) Intellectual Property Violations
Use of Services in violation of any trademark, copyright, or other intellectual property protection law or provision, or the acceptable use policy of any third‑party provider.
d) Unauthorized Software and Downloads
Downloading unauthorized software, including any unauthorized activity related to torrents, torrent trackers, or downloading unauthorized content.
e) Prohibited Industry Use
Use of Services for activities connected to the pornographic and/or adult entertainment industry, regardless of whether such activity is lawfully permitted.
f) Account Misuse
Providing access to an account, including the sharing of passwords, to any person other than the assigned user or pre‑authorized group users for that account.
g) Denial‑of‑Service Attacks
Participating in a denial‑of‑service (DoD) or distributed denial‑of‑service (DDoS) attack.
h) Unauthorized Access or Malicious Activity
Using the network to gain unauthorized access to any computer system or to intentionally install malicious code or any unauthorized program on any system.
i) Circumvention of Security Controls
Unauthorized attempts to circumvent data protection schemes or exploit security vulnerabilities, including running programs designed to identify security loopholes or decrypt protected data.
j) Interference with Operations
Knowingly or recklessly performing actions that interfere with the normal operation of Scale Computing systems, devices, or network infrastructure.
k) Resource Abuse
Deliberately wasting or overloading Scale Computing network or server resources, or those of any other system accessible through Scale Computing.
l) Mass Messaging Abuse
Sending inappropriate or unsolicited mass communications, including repeated postings to newsgroups, mailing lists, or individuals.
m) Improper Content Posting
Posting commercial or inflammatory material to forums or communities where such content is not appropriate.
n) Forgery or Impersonation
Forging communications to make them appear to originate from another person.
o) Unauthorized Monitoring or Data Access
Attempting to monitor or interfere with another user’s communications, or accessing, copying, modifying, or deleting another user’s data or software without explicit permission.
3) Notice of Infraction
Scale Computing will attempt to resolve minor infractions of the Acceptable Use Policy informally.
However, depending on the severity and potential impact of a violation, Scale Computing may, at its sole discretion and without liability:
a) Warning
Notify the individual user or customer point of contact with a warning.
b) Service Suspension or Termination
Disable, suspend, or terminate one or more Services for the affected user or customer, with or without prior notice.
c) Regulatory Notification
Notify and cooperate with appropriate federal, state, or provincial authorities.
